Legislature in America makes law and then case law and lawyers determine how that law is interpreted. What law system would have the legislature making law and interpretation and the judicial system ensuring justice.What kind of law system is it when legislature dictates punishment instead of case law?
There is no way that the judicial system would function without interpretation. What you would see is more laws like the Patriot Act - where all rights are stripped from our Constitution. Where prisoners of war are subjected to inhuman torture for years without representation or trial. It is a violation of the "Geneva Convention", and all of the other agreements (world wide) pertaining to war time treatment of prisoners. When George Bush ignored the Supreme Court's decision, and went ahead with his violations - that would the state of the world in all laws, if the court has no veto (over ride) power.What kind of law system is it when legislature dictates punishment instead of case law?
A pretty screwed up one. One without checks and balances.
